I continually encourage my clients and employers to err on the side of caution, and take the extra step to to comply with existing laws, rather than risk a situation where they have to defend themselves. 

The employee was within his rights, saying no (and then terminating) when they could have said yes, and avoided the situation, just made them look bad.</description>
